What is an Apostille?

An apostille is a special certificate attached to a public document that verifies the authenticity of the issuing official's signature and seal.

It says to other countries, "This document is legit; trust this signature and seal." This allows the document to be used effectively in foreign countries that are part of the Hague Apostille Convention (1961).

Think of it this way: If you have a birth certificate issued in the US and need to use it in France, French authorities might only recognize It if it's an American document. An apostille acts as a bridge, assuring them that the document is genuine and issued by a certified official.

Why May You Need an Apostille?

The word "apostille" (pronounced a-pos-TAY, not a-pos-TILL or a-pos-TEEL) might sound exotic, but its meaning is reasonably practical. It stems from a French verb meaning "to annotate," signifying its role in verifying a document's authenticity for international use. You can find more information about apostille in this article on our blog.

Think of an apostille as a legal passport for your documents. It assures foreign authorities that the issuing official, like a notary, was authorized when the document was signed. This process, called authentication or legalization, makes documents like court papers, vital records, and notarized certificates admissible in other countries.

Before 1981, this authentication process was a tangled web of forms. But thanks to the Hague Convention, the US jumped aboard in streamlining things. For countries within the Convention, getting an apostille is much simpler.

Steps for New York Apostille

Notarization is the official fraud-deterrent process that assures the parties of a transaction that a document is authentic and can be trusted. The central value of notarization lies in the Notary's impartial screening of a signer for identity, willingness, and awareness to detect and deter document fraud.

Before submitting for an apostille or certificate of authentication to the Department of State, documents must be authenticated by the County Clerk or a state official. If the Notary Public notarized the record, it must be submitted to the clerk in the County where the Notary is qualified. If a birth or death certificate issued in any of the five boroughs of New York City needs to be apostilled—it must bear a letter of exemplification.

The third step in the process is the issuance of the apostille or certificate of authentication by the New York State Department of State. An application form must be completed. The documents in question, properly authenticated, must be attached, and a fee must be paid. Notary911 provides a two-business day apostille for New York State-issued documents.
